Bookings and confirmation

A booking is only confirmed once we have confirmed it in writing. Requests submitted through the website are availability enquiries, not confirmed reservations.

All departures are subject to daily reserve permit availability. We operate daily except wednesdays between 08:00 and 17:00.

Prices and the reserve permit

Tour fees are quoted per rider unless stated otherwise. The compulsory Witzands Aquifer Nature Reserve permit and conservation fee of R300 per person entering the reserve is charged in addition to the tour fee and is set by the reserve, not by us.

Permit fees may change at the reserve's discretion. Where a change occurs after quotation but before your ride, we will inform you in writing before you pay.

Rider requirements and indemnity

Every rider, or the parent or legal guardian of a rider under 18, must sign an indemnity before departure. Riders must be physically able to operate the controls and to follow instructions from the guide.

We may refuse to allow any person to ride where, in the guide's reasonable judgement, that person is unfit to ride safely. This includes anyone under the influence of alcohol or drugs. No refund is due in these circumstances.

Conduct and the reserve

Riders must remain with the guided group and within permitted riding areas at all times. The reserve is a protected conservation area; littering, off-route riding and disturbance of vegetation or wildlife are prohibited.

Riders are responsible for damage caused to equipment through reckless or prohibited use.

Safety and assumption of risk

Quad biking is an adventure activity that carries inherent risk of injury even when conducted with training, equipment and supervision. Participation is voluntary and at your own risk.

Helmets and safety equipment are provided and must be worn for the duration of the ride.

Liability

Nothing in these terms excludes liability that cannot lawfully be excluded under South African law, including the Consumer Protection Act 68 of 2008. Subject to that, our liability in respect of any booking is limited to the amount paid for that booking.

We are not liable for indirect or consequential loss, or for loss of personal property in the reserve.

Weather and reserve closures

Rides may be delayed, shortened or cancelled where wind, visibility, fire risk or a reserve instruction makes riding unsafe. In those cases we reschedule or refund in line with our refund policy.

Governing law

These terms are governed by the laws of the Republic of South Africa, and the courts of the Western Cape have jurisdiction.
